New York area construction worker killed in crane accident

The parents of worker killed by a crane have been awarded $1 million in the settlement of a wrongful death lawsuit.  The couple's 30-year-old son was working for Yonkers Contracting when the cable on a crane snapped.  The cane then collapsed and crushed the young worker.

The accident occurred at the Metropolitan Transportation Authority's No. 7 subway project in April of 2012.  The cable on the giant boon snapped while in operation.  Investigators concluded that the cable was frayed and that the owners of the crane failed to pay attention to the condition of the cable.

The U.S. Occupational Safety and Health Administration determined that there were at least 10 violations of OSHA rules. Yonkers Contracting was thus fined $68,000. An area OSHA director stated that if procedures had been followed this accident could have been prevented.

We hear about accidents of this type periodically in the New York area. Rather than have equipment repaired or spending the extra time to inspect all equipment, employers go ahead and operate construction machinery in hopes that nothing bad will occur. However, as the above incident indicates, taking shortcuts on safety can lead to severe injury or death for construction workers.

Despite the parents receiving a large settlement in this matter, these sorts of cases are not easy to litigate. Determinations as to how the accident occurred need to be made. In certain instances, it could be the fault of the employer, a problem with the manner in which the equipment was manufactured or a combination of factors.

Attorneys representing victims of construction accidents must have the resources and knowledge to make a determination as to what occurred. These attorneys must then be able to put into words why parties being sued must be held accountable.
