SSDI And Mental Disability Claims

A person does not always have to have a physical injury or disease to receive Social Security Disability Insurance (SSDI). Psychiatric disorders, brain damage or cognitive deficits that interfere with steady employment may also qualify for disability benefits.

Dennis Kenny Law, has had good success with mental impairment cases on behalf of clients in the Newburgh area. With several offices in the Hudson Valley and Albany, New York, area, we extend a free initial consultation to individuals and their family members to explore a possible disability claim.

Social Security Disability Psychiatric Claims

The Social Security Administration recognizes certain mental illnesses as disabling:

  • Post-traumatic stress disorder (PTSD)
  • Clinical depression
  • Bipolar disorder (manic-depressive)
  • Anxiety disorders and panic attacks
  • Schizophrenia

Mental health claims require a record of regular treatment with a psychologist or psychiatrist (not a family doctor or counselor). We must also document how the mental illness prevents the person from working in a former job or sustaining other full-time work. Our lawyers can connect clients to accepted treating professionals who can diagnose a specific disorder and properly note the person’s limitations.

SSDI Neurological Impairment Claims

Some cognitive impairments automatically qualify for SSDI, but additional documentation is often required. Reduced mental capacity or neurological disorders can rule out many occupations. When a mild impairment is coupled with another condition (such as a back injury, headaches or depression), former low-level jobs may no longer be an option.

Our attorneys have had experience and results in neurological cases, including:

  • Traumatic brain injury (TBI)
  • Attention deficit hyperactivity disorder (ADHD)
  • Learning disabilities
  • Mental retardation and low IQ

We work to document the cognitive deficits, sensory problems, emotional behaviors and any secondary health concerns that together constitute a qualifying mental disability condition.
