Compensation for New York construction site accidents

When an individual is hurt on the job, he or she is generally entitled to workers’ compensation benefits, a personal injury settlement or both kinds of compensation. Only an experienced attorney can advise workers on which kinds of compensation may be available in their specific situations. However, New York law does provide numerous protections for workers who suffer construction accident injuries in both workers’ compensation and personal injury contexts.

For example, New York and a dozen additional states embrace a system of pure comparative fault when it comes to construction site accidents. Under this theory of liability, if an accident victim is not completely to blame for his or her injuries the victim may hold others financially accountable if they contributed to the accident.

Say that a worker fell from a height of a few stories and suffered painful but not fatal injuries. In this scenario, the worker was somewhat to blame because he was distracted by a prohibited cellphone buzzing in his pocket at the time of the fall. But because his employer had failed to train him properly in fall prevention and had failed to outfit him with protective equipment, the worker may hold his employer financially accountable for the company’s part in the worker’s fall.

If you have been involved in a construction site accident in New York, chances are that you can recover damages under workers’ compensation, personal injury or both kinds of claims. Please consult an experienced attorney who can help you understand your legal options.
